OVERVIEW

The enterprise licensing agreement (ELA) is a contract entered into by the Department of Premier and Cabinet (DPC) as the lead department and VMware Pty Ltd. The ELA sets out the terms under which the VMware software licences can be leveraged by the participating departments and agencies (buyers), and the costs of annual maintenance.

The ELA with VMware was extended on the 30 June 2017 for a period of 12 months.

KEY ELA BENEFITS

The ELA is a vehicle to aggregate the demand across buyers to improve the total cost of ownership of VMware products. It improves the value for money outcomes for buyers and reduces commercial risk.  

The ELA enables an efficient, streamlined and productive engagement process with VMware that reduces the time and resources needed by buyers to negotiate individual end user licence agreements for each transaction.

RULES OF USE: How to use this SPC

All procurements of VMware products covered by the ELA should be transacted via Data #3 or, subject to the following obligation, an authorised VMware reseller.

Where an authorised VMware reseller (other than Data#3) sells any VMware products covered by this ELA to Victorian Government agencies, that authorised reseller is required to advise the Department of Premier and Cabinet’s Primary Contact above, within 14 business days, of the full details of the transaction, which shall include – agency name, date of sale, product details, quantity sold, and selling price.

Agencies can procure VMware products against the VMware Government List Price provided the procurement is over $20,000 (List Price). With ELA discounts available against the VMware Government List Price, that Minimum Order value will reduce substantially. Data#3 may be able to assist in meeting any VMware Minimum Order Value by consolidating procurement from multiple agencies.

How to join the ELA

Agencies named above are entitled able to use the current ELA. New agencies can contact DPC to express interest in joining this ELA during 2017, but will need to sign the Participation Agreement with VMware.

If approved, that agency will be able to procure under the ELA during the ELA term, which will expire 30 June 2018.
